Conditions of sale
- SCOPE OF APPLICATION
The present conditions of sale ("ID GAMAX Conditions of Sale") regulate the sale of products by Industria y Desarrollo ID GAMAX, S.L., here in after referred to as ID GAMAX, to its customers via www.idgamax.com, hereinafter referred to as the "Website".
ID GAMAX operates through the Website for the Spanish territory, excluding the Canary Islands, Ceuta and Melilla, for France (metropolitan area), for Belgium, for Luxembourg, for Denmark, for Croatia and for Romania.
These terms and conditions of sale apply only in cases where customers purchase products from ID GAMAX.
- PRODUCT INFORMATION
The descriptions, photographs, graphic or iconographic representations and videos relating to the products, as well as trade names, trademarks or distinctive signs of any kind contained on the Website are intended to provide as much information as possible to the Customer. However, the user must bear in mind that they are for guidance purposes only and are therefore not exhaustive in nature.
ID GAMAX reserves the right to decide, from time to time, the products offered to the users through the Website. Thus, ID GAMAX may add new products to those included on the Website, it being understood, unless otherwise provided, that such new products shall be governed by the provisions of the terms and conditions in force at that time.
Likewise, ID GAMAX reserves the right to stop providing access, at any time and without prior notice, to any of the products offered on the Website.
The user of the service expressly acknowledges the exclusive ownership by ID GAMAX of any intellectual property rights concerning the pages that support all the services and contents of the Website regarding the appearance or look & feel, combination of colours, graphic logos, as well as the editorial contents of the website.
However, those contents whose ownership does not belong to ID GAMAX, shall be governed by the property rights established by their corresponding author. The external contents will have their own copying and distribution conditions that have nothing to do with those of ID GAMAX and, therefore, before carrying out any action with such contents, it would be advisable to check their respective conditions of use.
Without contravening the above, the user agrees that all content submitted to ID GAMAX for publication on the service shall be of a free and unrestricted nature. Accordingly, you hereby grant to this Web Site a worldwide, perpetual, non-exclusive, royalty-free right and license (including any moral rights or any other rights) to use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive, translate and create compilations and derivative works of such information, in whole or in part.
If, due to force majeure circumstances, a product is not available after the purchase has been made, ID GAMAX shall contact the user by email to reimburse the amount corresponding to the total or, where appropriate, partial cancellation of the order. The partial cancellation of the order does not entitle the user to cancel the entire order, without prejudice to the exercise of the right of withdrawal that corresponds to the user in accordance with the provisions of these Conditions.
In this regard, the customer, prior to purchasing the Product, must review the description and characteristics of the product and any other conditions that appear (including, but not limited to, compliance with any terms and conditions, rates and reservations established) and agree with them before purchasing the product. In the event of any conflict or contradiction, the product descriptions shall prevail over these Conditions of Sale. Consequently, the Customer must carefully read, in addition to reading and accepting these Conditions of Sale, the descriptions and conditions applicable to the sale of each Product, which shall be deemed to be accepted at the time the Customer proceeds with the purchase of the Product.
- PRODUCT PRICES AND SHIPPING COSTS
The prices and discounts applied to the products offered on the Website are based on the original retail price listed on the Website.
ID GAMAX reserves the right to change its retail prices at any time (including during a particular campaign or sale). Products will be charged to the customer at the price advertised at the time the order is placed.
ID GAMAX shall not be liable if it inadvertently publishes a product whose retail price is manifestly lower than the price offered on the market at the time of sale, such that the existence of such error was obvious. Nor shall ID GAMAX be liable in the case of sales where the final price is manifestly erroneous due to technical errors. In such cases, ID GAMAX will inform the customer as soon as possible and will cancel the order and reimburse the amount of the product/purchase to the customer. If the customer has already received the Product, he/she must return it to ID GAMAX (ID GAMAX will assume the cost of the return).
Product prices do not include shipping costs or possible surcharges for applicable taxes according to the billing areas.
Shipping costs will be applied once the products are included in the shopping cart and before the payment process. The Website offers the possibility of picking up the order at our facilities in Ripollet (Barcelona), without associated shipping costs, or shipping costs, recalculated the shipping price depending on the destination, the cubic capacity and the weight of the products included in the shopping cart.
These costs must be accepted by the customer when placing the order.
- PURCHASE OF PRODUCTS AND FORMALISATION OF ORDERS
In order to place an order, it will be necessary to register as a user, add the products and once validated in the shopping cart, click on "Checkout". It is necessary to select a shipping method and a payment method to complete the purchase.
After making the payment the customer will receive a confirmation email with all the details of your purchase. For more information, please go to the Orders section in My Account.
- PAYMENT OF THE PRODUCTS
The Customer must make the payment through the different options offered by the Website: credit or debit card Visa, MasterCard, American Express, Visa Electron and/or other similar cards, through the PayPal system, through the Bank Transfer payment system or through a credit bank transfer. The credit bank transfer payment system will only be available to customers who have been authorised to this form of payment.
The validation of the payment made by bank transfer will only be effective when it is verified that the amount has been received in the account. Proof of payment does not validate the purchase and does not expedite the shipment of the order.
Furthermore, ID GAMAX declares that it does not have access to or store sensitive data relating to the means of payment used by the Customer. Only the corresponding payment processing entity has access to this data for the management of payments and collections. Once the purchase process is completed, an electronic document is generated to formalise the contract. The Customer may print it and it is filed in the section My Account > Orders.
- CANCELLATION AND EXTENSION OF ORDERS
Customers may cancel or extend orders before receiving the product as long as the order has not been dispatched. To do so, it will be necessary to call +34935 912 818 or send an e-mail to info@idgamax.com.
In case of order extensions, shipping costs may be increased which will be specified for each case.
ID GAMAX reserves the unilateral right to cancel orders in cases relating to the verification of payments, of these Conditions of Sale or if ID GAMAX observes any defect in the products being sold.
- DELIVERY OF PRODUCTS (TIME, PLACE AND DATE)
Delivery period
The Website will inform the Customer, prior to the completion of the purchase process, of the delivery time of the Products.
ID GAMAX does not deliver Products on Saturdays, Sundays, national, regional and local holidays.
ID GAMAX may inform the Customer, by sending an email to his/her email address, the date of departure from the warehouse of the corresponding order of Products and the contact details of the transport company that will make the delivery. Within seventy-two (72) hours from that date, the Product will be delivered to the address indicated by the Customer, except in circumstances of force majeure. This period will depend on the transport and service requested by the Customer.
Delivery shall be deemed to have taken place from the moment at which the Product has been made available at the place of delivery indicated by the Client or at the corresponding collection point.
Place and conditions of delivery
ID GAMAX undertakes to deliver the order in perfect condition to the address indicated by the Customer which, in any case, must be within the areas defined in point 1 of these terms and conditions of sale. To optimise the delivery process, the address indicated by the Customer must be an address to which delivery can be made during normal working hours.
If at the time of delivery of the Product to the address indicated by the Customer, no one is present, ID GAMAX will contact the Customer, indicating how to proceed to arrange a new delivery with the relevant carrier. The Customer shall then contact the carrier as soon as possible to arrange a new delivery date. If, after arranging a new delivery date, the Product has not been delivered within a maximum period of seven (7) calendar days for reasons not attributable to ID GAMAX or the carrier, the Products shall be returned to ID GAMAX's warehouses, in which case ID GAMAX may charge the Customer for the shipping and return costs, as well as any associated handling costs.
The delivery address shall be that indicated by the Customer at the time of purchase. If the Customer, after making the purchase, would like to change the delivery address, he/she may do so if the order has not yet left our facilities. To do so, please send an e-mail to info@idgamax.com
ID GAMAX shall not be liable for any errors or damages caused in the delivery when the delivery address entered by the Customer does not exist, is incorrect or when the requirements for the change of delivery address previously indicated are not met.
At the time of delivery of the order, the Customer (or the recipient) must show an identification document to the carrier, check the apparent condition of the packages and sign and note on the delivery note (in the format presented by the carrier) any observations and reservations apparent at that time (e.g. due to missing packages or apparent damage or tampering with the Products or packaging). If the delivery note is in paper format, the Customer must request a copy of the delivery note from the carrier.
In the event that, on opening the packages containing the Products, the Customer notices that they are damaged due to transport, that they are incorrect or that items are missing from the same order, the Customer must notify our Post Sales Service by email to sat@idgamax.com as soon as possible and, if possible, within fifteen (15) calendar days of delivery.
RETURN OF PRODUCTS
Right of withdrawal
In accordance with the applicable legislation, the customer has a period of fourteen (14) calendar days from the delivery of the order to communicate its total or partial withdrawal of the purchase of the Product. Once the period of fourteen (14) calendar days has expired, ID GAMAX will not accept returns for withdrawal of Product purchases. The return made on time will not entail any penalty. However, the customer must bear the return shipping costs.
Return of defective Products.
The Customer shall be entitled to reimbursement of the price, shipping costs and return transport costs for defective Products or Products delivered if they do not correspond to the order placed, in accordance with the applicable legislation.
Refund
In the event of the exercise of the right of voluntary withdrawal (within 14 days of receipt of the order) or in the event of return of defective or incorrect products, the Customer shall be entitled to reimbursement of the returned Products, provided that they are in the same condition in which they were delivered: they have not been used (except as necessary to verify their suitability as expected), damaged or lost before arriving at ID GAMAX's premises or the requirements set out in these Conditions of Sale have not been met.
ID GAMAX will verify in its warehouse the suitability of the returned Product, reserving the right not to make the refund in case of detecting that the purchased Product and the returned Product do not match or that the return has not been made in accordance with these Conditions.
After verification of the return, and after verifying that the items have not undergone any manipulation, ID GAMAX will refund the customer the cost of the product minus, if applicable, the cost of return.
The customer must send the material in the same box or in a similar format, always safeguarding the goods from possible mishaps caused by transport. If the product is not sent in its original packaging, it may be subject to depreciation. To process a return an authorization form must be requested to our Post Sales Service via e-mail sat@idgamax.com . The RMA form (Return Merchandise Authorization) must be be placed on the outside of any of the packages.
ID GAMAX will manage the order for the refund of the price and shipping costs through the same payment system used by the Customer to purchase the Products, within forty-eight (48) hours from the confirmation of arrival at the warehouse of the returned order and, in any case, within a period not exceeding fourteen (14) calendar days from the validation of our After-Sales department.
However, the effective application of the refund of the price and shipping costs to the Customer's account or card will depend on the card and the issuing entity. The period of application of the price refund may be up to twenty-one (21) calendar days for debit cards and up to forty-four (44) calendar days for credit cards.
- GUARANTEE OF THE PURCHASED PRODUCTS
The Products have the legal guarantee established in the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users, for lack of conformity of these, which is manifested in a period of two (2) years from the date of delivery and in accordance with the provisions of the applicable regulations. The Customer must inform ID GAMAX of the lack of conformity within two (2) months of becoming aware of it.
The warranty does not include deficiencies caused by negligence, blows, use, improper manipulation or not carried out by the authorised technical service when applicable, or materials subject to wear and tear due to normal use or because they are consumable. Products modified or repaired by the Customer or any other person not authorised by the technical support service are excluded from the warranty.
The Customer shall not be entitled to exercise the warranty:
a) If he/she lacks the proof of purchase of the Products. In order to make use of the warranty, it is essential to keep the proof of purchase of the Products.
b) If the identification number of the warranted Product is manipulated or modified without the knowledge and authorisation of the technical service.
c) If any of the information on the Product guarantee provided or on the proof of purchase of the Products is modified, altered or replaced.
The Customer must at all times follow the Product information leaflet and the instructions for the correct use and installation of the Product, as well as all the information provided for the exercise of the legal (and commercial, if any) warranty.
The Customer may exercise the warranty on a Product in accordance with the regulations in force. The Customer shall contact ID GAMAX via the form provided on the Website to receive assistance on the steps to follow and the information necessary for the submission of the relevant claims.
In the event that a Product is non-conforming, and ID GAMAX cannot guarantee the replacement of the Product (previous model, out of stock or replaced reference), ID GAMAX will refund the Customer part or all of the price of the non-conforming Product, according to the conditions of the Product and as agreed with the Customer.
- ID GAMAX'S LIABILITY
Without prejudice to the provisions of the applicable regulations, the liability of ID GAMAX with respect to a Product sold by ID GAMAX shall be limited to the purchase price of said Product.
- COMPLETENESS AND AMENDMENT OF THE CONDITIONS OF SALE
The Conditions of Sale, in addition to the conditions published on the Product sheet, document the Customer's purchase of the Products and constitute the express and sole will of ID GAMAX and the Customer in relation to their subject matter and supersede and replace any other agreements or contracts, oral or in writing, previously reached by the parties. Any modification shall be made in writing and by mutual agreement between the parties involved.
ID GAMAX reserves the right to modify, at any time and after validation of the conditions by the Customer, these Conditions of Sale.
Customers and Users will always have these Conditions of Sale in a visible place, freely accessible for any queries they may wish to make. Customers and Users must carefully read these Conditions of Sale, which will have been validated prior to any acceptance of purchase. In any case, the acceptance of the Conditions of Sale in force at any given time shall be a prior and indispensable step to the purchase of any Product available through the Website.
- APPLICABLE LAW AND JURISDICTION
The present ID GAMAX Conditions of Sale are governed by Spanish law.
In case of controversy or disagreement arising from these Conditions of Sale or the purchase of Products through the Website and for the resolution of any disputes, ID GAMAX and the Customer or consumer User agree to submit, at their free choice, and waiving any other jurisdiction or venue to which they may be entitled, to the courts and tribunals of the city corresponding to the domicile of the Customer or consumer User. In the case of a non-consumer Customer or User, the parties agree to submit to the courts and tribunals of Ripollet.
For the purposes of these Conditions of Sale, "consumer" shall be understood to mean any person acting for purposes outside their trade, business, trade or profession, in accordance with Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users.
